Rental Policy

AGE REQUIREMENT
You must be 21 years old to rent the cabin. We will not rent to vacationing
students or singles under 21 years of age unless accompanied by an adult
guardian or parent. Any reservation obtained under false pretense will be
subject to forfeiture of advance deposit and/or rental money and the party will
not be permitted to check in. NO HOUSE PARTIES.
PAYMENT & CANCELLATIONS
Credit cards and personal checks are accepted. Full payment is required at the
time of booking unless the reservation is more than 5 weeks away. If the
reservation is more than 5 weeks away, we require $200 DOWN PAYMENT at the time
of booking and the balance is due 30 days prior to your arrival date. By using a
credit card with the online booking process, you agree to this agreement.
If paying by check, there is a $200 security deposit. A signed rental agreement,
$200 security deposit and the first payment of $200 will be needed to reserve
your stay. The balance is due 30 days prior to arrival date. Dishonored checks
for deposit or rent shall be subject to a $45 processing fee for redeposit.
We require a 45 day notice for cancellation. If the notice is provided, we will
refund the deposit less a $35 cancellation fee. If the cancellation is less than
45 days from your arrival date, the deposit is forfeited. No money will be
refunded if you leave prematurely during your stay, no exceptions. We recommend

SECURITY DEPOSIT:
When using a credit card as payment, there isn’t a security deposit we will hold
your credit card on file. If there are damages to the cabin during your stay, we
will bill your credit card and send you an invoice. You agree to this by booking
this cabin.
When using a personal check as payment, there is a $200 security deposit due
with in 5 days after you book your stay. The security deposit will be returned
within 14 days after your stay less any damages.
Any damage noticed upon arrival should be reported to the owner/agent
immediately. If damage is not reported, your credit card will be charged for the
cost of the repair. All general maintenance should also be reported so the cabin
can be kept in good repair. Please notify the owner or Cabin Services if
something is not working. In order to avoid any additional charges, the
following must occur:
a) No damage is done to the cabin or its content including the linens.
b) No items are missing upon the inventory check.
c) All debris, garbage and discards are placed in proper outside container.
d) All soiled dishes are placed in the dishwasher, and the dishwasher started.
e) There was no exceeding the maximum occupancy of the cabin.
f) The cabin is left in neat condition.
REFUNDS
We can not refund any monies due to any of these: TV, DVD, log fireplace, hot
tub, foosball table, gaming system, small appliances, etc. not working or
malfunctioning. No refunds will be given for acts of God, loss of electrical
power, water, air conditioning, or cable outages. Refunds will not be given for
ANY REASONS after check in.
The cabin is inspected prior to your arrival to ensure that all equipment is in
good working order. In the event of a mechanical failure, we will make every
effort to have all reported malfunctions corrected as promptly as possible
during regular business hours.
CHECK IN & CHECK OUT
Check-In: 4:00 pm
Please do not ask to check in early. In many instances, the cabin is cleaned
just prior to your arrival. If we let guests check in early, we have no way to
insure the cabin will be ready. Prior to your arrival, you will receive the
keyless lock code to enter the cabin.
Check-Out: 11:00 am.
We hate to see you go, but we must insist on a timely departure. Our
housekeepers need time to do their jobs well. Before you leave, please put your
dishes in the dishwasher and start it. Place your towels in a bathtub. Gather
all garbage and place it in the outside animal proof trash receptacle. Secure
all doors and windows. Make sure the thermostat is set on “auto” at 80° in the
summer or 55° in the winter.
OCCUPANCY
The maximum occupancy of Mountain Memories Cabin is 4 people. Maximum occupancy
limits are set by the State Fire Marshall's Office and may not be exceeded.
Exceeding the allowed occupancy will result in a breach and default under this
agreement. You will be asked to leave and forfeit all rents and security.
ADDITIONAL FEES
A ($55 2010 rate) ($60 2011 rate) Housekeeping Fee is in addition to the nightly rental rate.
WEATHER & DRIVING CONDITIONS
Though significant winter storms are rare, a four-wheel drive and/or tire chains
may be required during winter storms. Roads in the mountains can be difficult
during any season. Road surface conditions are not guaranteed at any time. No
changes or refunds will be given for fear of curvy or steep roads or due to the
weather. We do not provide transportation or take responsibility for towing
service. We recommend that you buy trip insurance; here is a link for

MAINTENANCE ISSUES
Rest assured that your cabin rental will be inspected prior to your arrival to
make sure everything is in working order. If a maintenance problem occurs during
your stay or if you have any questions when you arrive at your cabin, notify us
immediately at 614-620-0564 or Cabin Services at 865-774-0132.
We’ll do our best to accommodate your needs.
RIGHT OF ENTRY
The Owners or their representative, associates, employees and subcontractors
shall have the right to enter the property at reasonable hours for the purpose
of making repairs, servicing the hot tub or inspections.
PETS
Dogs are welcome in Mountain Memories cabin with prior approval. A
non-refundable ($50 2010 rate) ($75 2011 rate) per dog fee applies with a maximum of two (2) dogs that are
no larger than 65lbs. If you bring a pet without obtaining prior approval and
paying the per dog fee, you will be charged $200 and will be evicted without
refund.
The following dog policies are in place with the best interest of you and your
dog(s) while staying at Mountain Memories cabin. All dogs must be well behaved
and housebroken. All dogs must be crated when left alone in the cabin. All dogs
must be leashed at all times when outside of the cabin. Never leave your dog
restrained outside. The cabin is in the wooded foothills of the Smoky Mountains
and there are wild animals roaming. This could be hazardous if your dog(s) are
left outside unattended.
Dogs are not allowed on furniture at any time. Any evidence of pets on furniture
may incur extra cleaning fees. Very important, all dogs must be up to date with
vaccinations and on an existing prescription flea and tick program. Pet owners
are responsible for cleaning up any/all pet refuse and placing in the outside
animal proof garbage container. We have provided a shovel located on the side of
the cabin for easy removal of pet refuse. There will be a $50 charge if
housekeeping has to use the shovel to remove your dog(s) refuse. All items above
are the sole responsibility of the pet owner. The cabin owners assume no
responsibility for illness or injury that may incur to pets or humans while on
the premises or after their stay.
LONG DISTANCE CALLS
The cabin phone has free long distance within the continental United
States, Canada and Puerto Rico. All other long distance calling is blocked, you
must use your credit card or call collect.
FURNITURE
Place all furniture back in the arrangement in which you found it upon
arrival. Do not disconnect any cables or plugs from the television as this may
interfere with its working ability.
HOT TUB
There are certain health risks associated with the use of hot tubs. Each
registered guest is responsible for informing their guest of the possible risks.
Physicians strongly discourage pregnant women, skin sensitivities and persons
with hypertension from using a hot tub. Consult a physician if you have
questions or concerns before the use of a hot tub. The hot tub is drained and
serviced after each guest departs. Shower before entering hot tub. Bacteria on
your body can result in bacteria in the hot tub. Shower after using the hot tub.
Hot tubs are for enjoyment without the use of normal bathing products
(soap, shampoo, bath oil, etc.). These products will damage the hot tub and you
will be charged an additional $150 for cleaning or repairs if found in the hot
tub. The Cover is to be in place when the hot tub is not in use. DO NOT wear
jewelry in hot tub. We are not responsible for any damage or loss to jewelry of
any kind. A hot tub is not a swimming pool. Submersing in a hot tub by any
person can result in serious eye, ear and respiratory diseases. DO NOT SIT,
STAND ON OR MISTREAT the hot tub cover. A $450 charge will result in any
damages. DO NOT ALLOW CHILDREN TO PLAY IN THE HOT TUB OR BE LEFT ALONE FOR
ANY REASON.
FIREPLACE
The Fireplace is open October 1st to March 31st.
CONDUCT
You and your party agree not to disturb neighbors with loud noise or music or
unlawful or unsafe behavior. If you allow or participate in such behavior, you
will be asked to leave and will forfeit the remainder of your rental fee and
deposits. Participation in unlawful activities including illegal drugs,
environmental destruction, natural resource violations or public nuisance
violations may be cause for eviction. Any fines levied against the owner for
your misconduct will be your responsibility.
If you or anyone in your party damages or removes property from the premises,
you will be held responsible. Your electronic signature on the
confirmation/rental agreement gives us permission to charge your credit card a
minimum of $100 for such problems. If the repair or replacement costs exceed
$100, you will be charged the full amount.
SMOKING
Please no smoking in the cabin. Please do not throw cigarette butts in the yard
due to a fire hazard. We love our beautiful mountains and wildlife and would
hate to see them destroyed.
PROHIBITED ITEMS
You and your party are strictly prohibited from bringing illegal drugs,
firearms, fireworks, kegs, candles, incense, electric, kerosene or propane
heaters onto the premises of the Rental Cabin. Failure to comply with this
policy, you will be charged $200 and will be evicted without refund.
INDEMNIFICATION
THE OWNERS shall not be liable for any loss, injury, death or damages to
persons or property which at any time may be suffered or sustained by lessee or
by any person who may at any time, be using or occupying or visiting the leased
premises or be in, on or about the premises, whether the loss, injury, death or
damage shall be caused by or in any result from or arise out of any portion of
the premises, or shall result from or be caused by any other matter or thing.
Lessee shall indemnify the Owners against all claims, liability, loss or damage
whatsoever on account of any such loss, injury, death or damage. Lessee waives
all claims against the Owners for damages to the property of lessee in, on, or
about the premises, from any cause arising at any time.
CREDIT CARD AUTHORIZATION
I understand and consent to the use of the credit card provided without
original signature on the charge slip, I understand that by "clicking" that I
have read the terms and conditions of this property, I am bound by this
agreement and I have signed "electronically, and that this Credit Card
Authorization cannot be revoked and will not terminate until 90 days after
leased premises are vacated. Charges may include but not limited to: damages
beyond normal wear and tear.
